PHARMACISTS TO STAY ON DUTY DURING COURT APPEALS PROCESS
Date: 31-Mar-2007
The pharmacists of Dusini Drugs at New Philadelphia will continue to work while their appeals continue their way through Tuscarawas County Common Pleas Court.
Judge Edward O'Farrell granted requests for stays of execution of suspension issued against Scott A. Vinci, owner and head pharmacist at Dusini Drugs, and associate pharmacist Connie J. Campbell by the Ohio State Board of Pharmacy.
The pharmacy board decided last month to suspend Vinci's license for five years and Campbell's for three years.
Attorneys for Vinci, 40, of New Philadelphia, and Campbell, 46, of Mineral City, claim the suspensions were not based on reliable evidence.
Similar stays have been granted in the appeals of Strasburg Pharmacy owner and pharmacist Michael Dennis, 36, of Massillon, and associate pharmacist Amy Froman, 43, of Strasburg.
The board voted to permanently revoke Dennis' license and handed a three-year suspension to Froman.
Investigators claim Strasburg Pharmacy and Dusini Drugs were involved in a scheme to prescribe and provide large amounts of Vicodin, a narcotic painkiller, to the patients of the former Professional Pain Management of Ohio clinic at New Philadelphia.
Pharmacy board officials have stated that the pharmacists should not have filled the thousands of prescriptions issued by the pain clinic because they were not prescribed for a legitimate medical purpose.
The clinic has been closed since a 2003 raid.
